Although it took three hours, I received the most through eye exam that I have ever experienced. Met with Dr. Franz and he was very patient and took the time to answer all of my questions.

I had a bad experience with Frantz EyeCare center today. I was a new patient and filled out all the extensive requisite paperwork - both the online and mailed paper forms. Upon presenting to the registration desk, I was presented with an additional form that was explained is not included in the online package nor the mailed forms - it is an "arbitration" agreement document. I read the document in full and while I'm not a lawyer I'm very experienced in dealing with contracts. I believe Frantz's arbitration agreement is a significant legal document which severely limits an individual's rights and remedies. For example:
1. The arbitration is binding meaning that you agree to accept the results no matter what with no recourse. In a court, you at least have the appeals process.
2. The arbiter is required to be a physician vs an impartial judge in a court.
3. You waive all punitive damages in the document. This means if the doctor came in drunk that day and caused you severe damage, you may get direct damages via arbitration, but you wouldn't get anything over and above as a penalty for a willfully negligent decision.

The worst part of this is Frantz's deceptive business practice of handing you this form at the last minute and requiring you to sign it or you won't be seen. I declined and wasn't seen. I would imagine a great percentage of folks presented with the document don't understand what it truly means. And since I'm not intimately familiar with Florida arbitration law - I probably don't either. But what I do know is that I don't want to do business with a healthcare organization that feels like they need to protect themselves from negligence and spring a significant legal document on you at the last minute - my eyes are too important to me.
